{"id":129973,"date":"2015-06-30T12:26:20","date_gmt":"2015-06-30T12:26:20","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=129973"},"modified":"2015-06-30T12:26:20","modified_gmt":"2015-06-30T12:26:20","slug":"nobody-can-prosecute-using-judgment-debt-findings-lawyer","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=129973","title":{"rendered":"Nobody can prosecute using judgment debt findings \u2013 Lawyer"},"content":{"rendered":"<p style=\"text-align: justify;\">A private legal practitioner, Egbert Faibille has disclosed that the adverse findings made by the Judgment Debt Commission cannot be used as evidence to prosecute persons indicted in the report.<\/p>\n<p style=\"text-align: justify;\">[contextly_sidebar id=&#8221;W1jf67UlSCCHSUa2aj7OUNExHtdW2aNz&#8221;]Egbert Faibille said\u00a0this on the <strong>Citi Breakfast Show<\/strong> in relation to revelations in a <span style=\"color: #666699;\"><strong><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/06\/29\/woyome-judgment-debt-trial-judge-erred-betty-mould-was-ignorant-report\/#sthash.BcwZEoIK.0jQ3nWhI.dpbs\" target=\"_blank\">leaked report by the Commission<\/a><\/strong><\/span> as well as incriminating findings by the <span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/06\/27\/gfa-to-sue-over-misleading-dzamefe-report\/#sthash.oP61VIEa.dpbs\" target=\"_blank\"><strong>Dzamefe Commission<\/strong><\/a><\/span> which was tasked to investigate Ghaan&#8217;s participation at the 2014 world cup.<\/p>\n<p style=\"text-align: justify;\">The Judgment Debt Commission&#8217;s report among other things, faulted the Attorney General\u2019s Department and the trial judge for failing to prevent the controversial GH\u00a251 million judgment debt to businessman, Alfred Agbesi Woyome.<\/p>\n<p style=\"text-align: justify;\">According to him, Ghana\u2019s Constitution does not allow for processes to be initiated against persons who give self-incriminating evidence to Commissions of Inquiry.<\/p>\n<p style=\"text-align: justify;\">\u201cIt is because the adverse findings become a judgment of the High Court appealable to the Court of Appeal by the person in respect of whom the adverse findings have been made. I think at after six months, any person in respect of whom adverse findings have been made by a particular commissions report has the right of an appeal. So a judgment is already in existence by reason of the operation of the law.\u201d<\/p>\n<p style=\"text-align: justify;\"><a href=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2015\/06\/Woyo-Betty.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-129840 size-full\" src=\"http:\/\/4cd.e16.myftpupload.com\/wp-content\/uploads\/2015\/06\/Woyo-Betty.jpg\" alt=\"Woyo Betty\" width=\"650\" height=\"450\" srcset=\"https:\/\/citifmonline.com\/wp-content\/uploads\/2015\/06\/Woyo-Betty.jpg 650w, https:\/\/citifmonline.com\/wp-content\/uploads\/2015\/06\/Woyo-Betty-300x208.jpg 300w\" sizes=\"auto, (max-width: 650px) 100vw, 650px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">The Commission further recommended that the state should take all necessary steps to retrieve all monies paid Alfred Agbesi Woyome.<\/p>\n<p style=\"text-align: justify;\">Many Ghanaians who contributed on the <strong>Citi Breakfast Show<\/strong>, called for those indicted in the report to be made to face the law for causing financial loss to the state.<\/p>\n<p style=\"text-align: justify;\"><strong>They find fact and make recommendations<\/strong><\/p>\n<p style=\"text-align: justify;\">The legal practitioner explained that per the 1992 Constitution, Commissions of Inquiry are established to perform basically two functions \u2013 \u201cfind fact and to make recommendations to forestall or prevent the recurrence of the developing\u2019s that have resulted in the setting up of the very commission we are talking about in relation to the law.\u201d<\/p>\n<p style=\"text-align: justify;\">Egbert Faibille further explained that: \u201cAs a nation, Ghana has had a checkered history with respect to Commissions of Inquiry\u2026Before the 1992 constitution came into being, the First Republic had a certain arrangement which ensured that persons hauled before Commissions of Inquiry, are prosecuted per the adverse findings made against them. It was law in this country then.\u201d<\/p>\n<p style=\"text-align: justify;\">He added that the said law was amended in 992 adding that \u201cthe framers of our 1992 constitution were of the considered opinion that the regime under the First Republic, where persons in respect of adverse findings made against them after appearing before Commissions of Inquiry, were prosecuted was wrong and that it infringes on the fundamental human rights of a person.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cSo the 1992 constitution departed from the standard as we had in the past. So now, when adverse findings are made against you by a Commission of Inquiry, those adverse findings after the flashing of time become a judgment of the High Court in respect of which, if you have a subject matter of the adverse findings, then you have the right to appeal to the court of Appeal.\u201d<\/p>\n<p style=\"text-align: justify;\">&#8211;<\/p>\n<p style=\"text-align: justify;\">By: Godwin A.
