{"id":117472,"date":"2015-05-19T12:01:01","date_gmt":"2015-05-19T12:01:01","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=117472"},"modified":"2015-05-19T12:01:01","modified_gmt":"2015-05-19T12:01:01","slug":"samsung-wins-appeal-against-apple-claim-of-iphone-copying","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=117472","title":{"rendered":"Samsung wins appeal against Apple claim of iPhone copying"},"content":{"rendered":"<p>A US federal appeals court handed a partial victory to Apple, ruling Samsung infringed the iPhone maker&#8217;s intellectual property but setting aside part of a USD 930 million jury award.<\/p>\n<p>The US Court of Appeals for the Federal Circuit, which handles patent lawsuit appeals, affirmed a jury&#8217;s findings that Samsung infringed several Apple patents.<\/p>\n<p>The appeals court, however, ruled against Apple&#8217;s so-called &#8220;trade dress&#8221; claims related to the distinctive look of the iPhone, the Wall Street Journal reports.<\/p>\n<p>The appeals court sent the case back to the trial level for the damages award to be reduced for the portion of the case Apple lost on appeal.<\/p>\n<p>Samsung had been seeking to have the jury award lowered by USD 382 million because of the jury&#8217;s trade-dress findings that Samsung argued were erroneous.<\/p>\n<p>The appeals court battle came after an August 2012 trial in San Jose in which a federal jury found that a range of Samsung devices, including the Galaxy S II and the Droid Charge, infringed Apple&#8217;s patents.<\/p>\n<p>Jurors originally awarded USD 1.05 billion in damages, but that figure was reduced to USD 930 million after the judge called for a retrial on some damages issues.<\/p>\n<p>&#8211;<\/p>\n<p>Source: Telecom Paper<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A US federal appeals court handed a partial victory to Apple, ruling Samsung infringed the iPhone maker&#8217;s intellectual property but setting aside part of a USD 930 million jury award.
