{"id":111899,"date":"2015-04-28T06:00:06","date_gmt":"2015-04-28T06:00:06","guid":{"rendered":"http:\/\/4cd.e16.myftpupload.com\/?p=111899"},"modified":"2015-04-28T06:06:43","modified_gmt":"2015-04-28T06:06:43","slug":"its-commonsensical-to-consult-before-appointing-ec-boss-mike-oquaye","status":"publish","type":"post","link":"https:\/\/citifmonline.com\/?p=111899","title":{"rendered":"It&#8217;s &#8216;commonsensical&#8217; to consult before appointing EC boss \u2013 Mike Oquaye"},"content":{"rendered":"<p style=\"text-align: justify;\">A former Second Deputy Speaker of Parliament and a political historian, Professor Mike Oquaye has added his voice to the raging debate over whether President Mahama should consult widely before appointing a new Chairman of the Electoral Commission (EC).<\/p>\n<p style=\"text-align: justify;\">According to Professor Mike Oquaye, opening up the appointment of the Chairman of the EC to wider consultation is only \u201ccommonsensical.\u201d<\/p>\n<p style=\"text-align: justify;\">He argued that the directive though not enshrined in the constitution, is in the right direction and democratically sane.<\/p>\n<p style=\"text-align: justify;\">[contextly_sidebar id=&#8221;jrSZnniLnSBAM7Ar7yovmwfBt98js6cx&#8221;]His view sharply deviates from that of the\u00a0former Supreme Court Judge VCRAC Crabbe who believes the <a href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/04\/23\/council-of-state-should-appoint-ec-chair-vcrac-crabbe\/#sthash.tgLnGt7n.SbMYJXpx.dpbs\" target=\"_blank\"><span style=\"color: #666699;\"><strong>President should stick<\/strong> <\/span><\/a>to what the constitution says.<\/p>\n<p style=\"text-align: justify;\">\u201cWhen the constitution uses such language acting in accordance with the advice of the council of state, in essence, it is the council of state which is making the appointment, because the expression shall act in accordance is mandatory and therefore in law at least the president is bound by the decision of the council of state,\u201d he noted.<\/p>\n<p style=\"text-align: justify;\">The current Chairman of the EC, Kwadwo Afari Gyan is due for retirement in June 2015 and government is currently working on finding a suitable replacement.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/04\/13\/make-new-ec-boss-appointment-transparent-mp-to-mahama\/#sthash.jbGBvRW4.dpbs\" target=\"_blank\"><strong>Several persons<\/strong><\/a><\/span> including flagbearer of the New Patriotic Party (NPP), Nana Addo have called on President John Dramani Mahama to <span style=\"color: #666699;\"><strong style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/04\/20\/make-ec-boss-appointment-transparent-nana-addo-to-mahama\/#sthash.ZSBP9kO5.dpbs\" target=\"_blank\">make the appointment process transparent<\/a><\/strong><\/span>.<\/p>\n<p style=\"text-align: justify;\">The General Secretary of the governing National Democratic Congress (NDC), John Asiedu Nketia has insisted\u00a0that the President <span style=\"color: #666699;\"><a style=\"color: #666699;\" href=\"http:\/\/4cd.e16.myftpupload.com\/2015\/04\/25\/prez-must-stick-to-constitution-in-appointing-ec-chair-gen-mosquito\/\" target=\"_blank\"><strong>should not deviate from the constitution<\/strong><\/a><\/span>.<\/p>\n<p style=\"text-align: justify;\">However Professor Mike Ocquaye in an interview on Eyewitness News on Monday, insited that it should not be \u201clike a hoodwink for the people of Ghana.\u201d<\/p>\n<p style=\"text-align: justify;\">\u201cThe constitution doesn\u2019t go into such details, but it is commonsensical. It is in the art of good governance, it is in the art of promoting and deepening democracy that before you take a decision that touches and concerns all the people, before you appoint and rest free that all others can expect which will ease tension and bring peace to our democratic and electoral process, you must subject it to public debate.\u201d<\/p>\n<p style=\"text-align: justify;\"><strong>Wider consultation makes sense <\/strong><\/p>\n<p style=\"text-align: justify;\">He further argued that opening up the process for consultation makes sense, &#8220;If the constitution says the President has the discretion to even appoint his own ministers, it makes sense for the President to consult people.&#8221;<\/p>\n<p style=\"text-align: justify;\">&#8220;If you want to appoint an Attorney General and you consult senior lawyers and the bar council to\u00a0 know the track record of that proposed attorney general.
