The Tribunal concluded that the evidence did not demonstrate that Balkan had conferred any demonstrable benefit on the government.\u2019\u2019<\/p>\n<p>&#8221;Instead, the Tribunal awarded Balkan limited damages of $12 million US for work performed and rejected the bulk of <span class=\"GINGER_SOFTWARE_mark\" id=\"e450150e-1ac3-471f-b524-c9fc786e229e\">Balkan\u2019s claim<\/span> of alleged expenditures,\u2019\u2019 the statement added.<\/p>\n<p>Meanwhile a former Attorney General, Nii Ayikoi Otoo said per the statement <span class=\"GINGER_SOFTWARE_mark\" id=\"77eaf3dc-2f4e-4aa5-8338-1495ddefa85f\">by<\/span> the AG\u2019s department the amount Ghana is paying in law can be referred to as <b>Quantum M<\/b><b>eruit<\/b> [reasonable value of service].<\/p>\n<p>&#8221;If the Attorney General is telling us that the International arbitration has awarded $12 million for work done on the barge, then I do not think there is anything wrong with it,&#8221; he stated.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Below is the full statement signed by the Attorney General<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p align=\"center\"><b>MINISTRY OF JUSTICE &amp; ATTORNEY GENERAL<br \/>\n<span style=\"text-decoration: underline;\">PRESS RELEASE<\/span><\/b><b><\/b><b><\/b><\/p>\n<p><b><span style=\"text-decoration: underline;\">For Immediate Release<\/span><\/b><\/p>\n<p><b>TRIBUNAL REJECTS CLAIMS FOR $3 BILLION US AGAINST GHANA<\/b><\/p>\n<p>In a substantial decision issued on Tuesday, April 1st, the Permanent Court of Arbitration in The Hague rejected claims against the Government of Ghana, brought by project developer Balkan Energy (Ghana) Limited, an affiliate of Texas-based Balkan Energy Company.<\/p>\n<p>Balkan had claimed damages totaling more than $3 billion US based on a tolling fees provision in a long-term Power Purchase Agreement entered into in 2007 between <span class=\"GINGER_SOFTWARE_mark\" id=\"b41c70f3-30d8-48e5-b276-8d74982b34fe\">Balkan<\/span> and the Government&#8217;s Ministry of Energy (PPA).<\/p>\n<p>While upholding the validity of the PPA, the Tribunal found that Balkan had failed to perform its obligations under the PPA, which required Balkan to refurbish and commission the Osagyefo Power Barge, a 125 MW dual fired power <span class=\"GINGER_SOFTWARE_mark\" id=\"1e088f80-cbc4-49a9-a3e0-733fb82f34f9\">barge<\/span> and associated facilities in <span class=\"GINGER_SOFTWARE_mark\" id=\"18a21999-8ee3-425b-89b5-d22eb50ed0e0\">Effasu<\/span> in the Western Region.<\/p>\n<p>The Tribunal also rejected Balkan\u2019s claim for over $40 million US in damages for unjust enrichment. The Tribunal concluded that the evidence did not demonstrate that Balkan had conferred any demonstrable benefit on the Government.<\/p>\n<p>Instead, the Tribunal awarded Balkan limited damages of $12 million US for work performed and rejected the bulk of <span class=\"GINGER_SOFTWARE_mark\" id=\"eccf547f-275e-43b3-80cc-4439091d5fd1\">Balkan\u2019s claim<\/span> of alleged expenditures.<\/p>\n<p>Finally, the Tribunal held that the PPA was terminated and returned control of the Barge to the Government. The Government was further awarded $300,000 US in damages, the maximum amount of damages that it could award the Government under the PPA.
