The Supreme Court will today [Wednesday] decide on the constitutionality of the Constitution Review Commission.
[contextly_sidebar id=”xZqnWYCpnFsqUi9kwTstvJi5kmCQrIV6″]In a landmark case, US-based Ghanaian professor, Stephen Kwaku Asare, filed a suit at the Supreme Court, seeking to nullify the constitution review process currently being undertaken by the Constitution Review Implementation Committee (CRIC).
The committee, chaired by Prof. Emmanuel Victor Dankwah, was set up by government to make proposals for the review of the constitution which will then be subjected to a vote at a referendum.
Professor Asare argues that the CRIC have no power to schedule a referendum or to amend the Constitution.
He also stated that he had taken the case up with the Supreme Court and had requested the court to “issue an order” directing all relevant bodies “to permanently cease and desist from taking any actions that seek to amend or otherwise disturb the Constitution.”
Professor Asare added that he is prepared to “litigate this matter to its logical conclusion” to ensure that the constitution was not amended on the recommendation of the committee.
But the Attorney General, Marietta Brew Appiah-Oppong in her response disagreed.
According to the her, the President did not err in appointing the committee and that in the performance of their duties the CRIC has not breached any law.
